What's Legal? 

Often in high-bandwidth hosting, legal issues arise.  Many of the most bandwidth-intensive applications are adult-related, such as serving an adult web site, adult streaming video, or adult file download servers. 

As a registered New Jersey Corporation, we must abide by the laws of New Jersey, the United States of America, and the laws of the states in which we host servers (primarily Virginia and California). 

As a general rule of thumb, we do allow hosting of adult materials!  When hosting adult sites, however, we require that our clients:

  • Refrain from hosting or exploiting images or videos containing anyone under the age of 18.
  • Present signed documentation to us certifying that all subjects are over the age of 18, and indicating the physical location in which legal records containing proof-of-age are stored.
  • Refrain from hosting anything that may be considered illegal in the United States of America, the State of New Jersey, or the Commonwealth of Virginia.

We also kindly request that our clients:

  • Require proof-of-age for their customers.  This may be done by our clients in-house, or may be provided by a third-party company.
  • Do not make photographs or videos containing full frontal nudity available to users that have not presented proof-of-age.

 

Examples of What's Allowed*:

  • Open-source software mirroring.
  • Commercial software mirroring.
  • Streaming audio, video, or shoutcast servers, providing non-copyrighted materials, materials to which you own the copyright, or copyrighted materials to which you have been granted permission to redistribute.
  • Legal adult sites, containing subjects over the age of 18 only.

Examples of What's Not Allowed*:

  • Hosting of "pirated" commercial software, or "warez."
  • IRC server hosting.
  • Hosting of an adult site containing subjects under 18 years of age or containing materials that are considered illegal, such as bestiality.
